These products are offered for sale with telematic tools organized by the seller, suitable for the stipulation of a contract between him and the buyer, who may be either a natural person acting for purposes unrelated to the business activity, or a natural or legal person acting in the exercise of one's own entrepreneurial or professional activity.

The products covered by the contract are only those contained on the site www.artnwine.it "Shop" section and its subsequent updates.

The "on-line sales contract" is a sales contract relating to the supplier's material goods, entered into between the supplier and the buyer as part of a distance selling system.

8. Commercial Mode

8.1 How to order

8.2 Developments

Upon receipt of the order, we will contact you immediately to confirm receipt of the order, the availability of the products and the estimated timing for production and delivery.

Once the payment has been received, Art 'n Wine di CV will issue a tax invoice in the name of the natural or legal person who placed the order, sending it electronically to the Customer. The Customer is solely responsible for the accuracy and truthfulness of the information provided to Art 'n Wine di CV for billing purposes. The invoice issued cannot then be modified.

In case the order cannot be accepted, Art 'n Wine will send the Customer an e-mail reply in which it will communicate the impossibility of accepting the order, with relative reasons and indications.

In the event that Art 'n Wine di CV, after the payment made by the Customer, should not be able to deliver the requested products or services, the responsibility will not go beyond the return to the Customer of the amounts already paid, without has, in favor of none of the parties, any compensation for default, consequential damage or loss of profit.

The indications of the times relating to production and delivery forwarded by Art 'n Wine to the Customer are to be considered approximate and do not determine penalties or assumptions in default.

No production or shipment of the goods will be started without payment.

8.3 Shipping, delivery and receipt

At the end of the production we will send the Customer a communication of "Production completed".

We will pack and deliver the products to the carrier, sending another notification to the Customer of "Delivery to the Carrier"

The packaging will be accurate and the shipment will always take place with insurance coverage.

As soon as the carrier arranges for the shipment, we will send the customer the details to follow the progress of the transport.

The products will be sent to the address indicated by the Customer. There will be the possibility for the customer to change the address only before the delivery of the packages to the carrier. Subsequently, it will no longer be possible to communicate any change of destination address.

The Customer is required to provide Art 'n Wine, who will then communicate them to the carrier, with the most complete and precise information regarding the delivery specifications (addresses, contact details, references, any logistical difficulties, etc.)

From the moment the products are delivered to the carrier, the risks and title for loss or damage pass to the carrier, excluding Art 'n Wine di CV from any liability.

From the moment of their delivery to the Customer, with acceptance of the latter, the risks and the ownership of losses or damages pass to the Customer, excluding Art 'n Wine of CV from any liability.

Upon receipt of the products, in the event of visibly damaged packaging, the Customer is required to check the products, accepting the delivery "with reserve", indicating it on the carrier's transport document. In the event of tampered with or damaged products, Art 'n Wine of CV must be contacted no later than 24 hours from receipt, with an e-mail to the address artnwine@artnwine.it in which the extent of any damage or tampering is indicated in detail. After 24 hours, any notification of damage will no longer be valid.

In case of non-delivery to the Customer after 10 working days from delivery to the carrier, the Customer will be refunded the amount already paid upon confirmation of the order.

In the event of a delay in delivery of more than 30 working days with respect to what Art 'n Wine approximately indicated to the Customer in the order confirmation, the Customer may withdraw from the order by means of a written complaint. Also in this case the Customer will be refunded the amount already paid upon confirmation of the order.

9. Refund and Return Policy

9.1 Right of withdrawal

In accordance with the provisions of articles 64 and following of Legislative Decree 6 September 2005 n. 206 (and subsequent amendments and additions), the Customer (consumer), if not satisfied with the products or the content of the services purchased at Art 'n Wine di CV, will be able to return the same products and obtain a refund of the price already paid at the time of Prepayment.

To this end, the Customer must contact Art 'n Wine di CV within 14 days following the delivery of the products with a written communication sent by registered letter with return receipt and e-mail message to the e-mail address artnwine@artnwine.it  containing all the necessary and useful information for a correct processing of the return and refund procedure.

This communication must necessarily contain all of the following:

  1. the express will of the Customer to withdraw in whole or in part from the purchase contract;
  2. the number and copy of the document (invoice - transport document) proving the purchase of the order with respect to which you intend to exercise the right of withdrawal;
  3. the description of the products with respect to which the right of withdrawal is exercised;
  4. the details for payment by bank transfer

9.2 Effects of withdrawal

Following receipt of the communication with which the Customer communicates his willingness to exercise the right of withdrawal, Art 'n Wine di CV, having verified the correspondence to the above requirements, will communicate to the Customer by e-mail the methods with which return the products.

The return of the products in favor of Art 'n Wine di CV must take place within 10 days following the communication of the intention to withdraw.

From receipt of the products, to their return, the Customer is required to keep and keep the products received and for which he intends to exercise the right of withdrawal with the utmost care and diligence, keeping them intact together with the original internal and external packaging.

All expenses and risks resulting from the transport operations for the return of the products are to be fully borne by the Customer, without prejudice to the latter's right to insure the shipment, bearing the relative expenses.

In no case will it be possible to manage the return of the products or the exchange of the goods directly at the headquarters of Art 'n Wine of CV. Only the return of the products by courier or postal service is permitted. 

When Art 'n Wine receives the products shipped by the Customer who has exercised his right of withdrawal, it will refund the amount of the sums already paid by the Customer in the advance payment.

The incorrect exercise of the right of withdrawal, according to the regulatory and contractual provisions, legitimates Art 'n Wine to return the products returned by the Customer to the sender, with an increase in transport costs.

9.2 Exclusion of the right of withdrawal

The right of withdrawal is excluded where the Customer has started to use the purchased products.

The return of the products and the refund of the consideration are always subject to the integrity of the products purchased.

Art 'n Wine will only accept minimal wear of the product, due exclusively to its testing to make a decision regarding its definitive purchase, without the condition of the product having been altered at the time of delivery.

In case of excessive use of the goods, the return will not be accepted.

Art 'n Wine will not accept returns of products handled by the Customer, or of goods that will be returned incomplete with their main elements and accessories.

It is not possible to exercise the right of withdrawal for some types of distance selling, indicated by art. 55 as in the specific case of goods made to measure or customized for the customer.

Professional Clients who act in the context of an entrepreneurial activity will not be able to exercise the right of withdrawal.

10. Presentation of ideas

Do not submit any ideas, inventions, copyrights or other information that may be considered your own intellectual property that you would like to submit to us, unless we have first signed an intellectual property agreement or non-disclosure agreement. If you disclose it to us in the absence of such written agreement, you grant us a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, store, adapt, publish, translate and distribute your content in any existing or future media.

. Art 'n Wine will not be responsible for any damages that may arise from misuse or wear. The warranty does not apply in the event of factors unrelated to the normal use of the product or incorrect or abusive use by the customer or third parties not authorized by the manufacturer.

The guarantee is also excluded for defects that were already known to the customer at the time of purchase.

12.3 Mode

It is up to the Customer, before returning a non-compliant item, and in order to enforce the guarantee, to agree with Art 'n Wine, also by e-mail, within 10 days of reporting the lack of conformity, the methods of return and delivery of the product. Art 'n Wine, having received this communication, undertakes to indicate to the Customer the place and method of delivery of the product.

If the Customer, within the aforementioned term of 10 days starting from the notification of the lack of conformity, fails to agree with Art 'n Wine the methods of exercising the guarantee, including the methods relating to the return of the product, he will forfeit the right to worth the warranty.
